1 BOOKING PROVISIONAL

Provisional bookings are accepted by electronic booking form at this website (www.skolajachtingu.cz). Provisional booking is not deemed binding upon the School or the Student. Upon receiving the provisional booking the School will send the invoice with payment details via email.

2 FIRM BOOKINGS

Booking will be deemed firm once the minimum Deposit (or the total course price, if booking is made within 28 days prior to the start of the course) is paid.

3 CONFIRMATION

The School will confirm the booking by sending the invoice.

4 DEPOSIT

A 50% deposit is required if the booking is over 28 days from the date of the course as per the enclosed literature.

1. The balance of payment is due 28 days prior to the date of the course.
2. If within 28 days of the date of the course full fee is required.
3. If within 28 days prior to the course the Student has not paid the balance of the fee, on the 28th day a reminder email will be sent to the address given in the online booking form. If 21 days from the date of the course the balance has not been received the School reserves the right to sell the Student’s berth.
4. If the School is successful in selling this berth and mitigating its costs the student will only forfeit the deposit.
5. If the School fails to sell the berth, the Student will be liable for the full fee.

5 COURSE DURATION
5-Day Practical Courses, from approximately 1800 hours Saturday until 1800 hours the following Thursday. 6-Day Practical Courses, from approximately 1800 hours Saturday until 0900 hours the following Saturday. Practical Exam following the practical Course starts usually the evening or the next day after the finish of the course. The duration of the exam is 1–2 days, according to the number of parcticipants. The exam time plan will be announced prior to the start of the preparation course.
Note that these are only a guide and any variation will be announced prior to the course commencing. On practical courses, the times are, of course, dependant upon the weather conditions and the Instructor's/Skip­per's decisions and the sea-worthiness of the vessel at the time.

6 DELAY/NON ARRIVAL/CANCEL­LATION

1. If you are likely to be delayed beyond the start of your course, please inform us as early as possible.
2. A student who cannot attend their course through illness or commitments elsewhere is requested to contact the school as soon as possible. If it is necessary to cancel the course within twenty eight days of commencement of the course every possible attempt will be made to mitigate the Student’s costs, to let the berth elsewhere. If successful the Student will only forfeit the deposit. If unsuccessful the Student will be liable for the full fee. Travel and cancellation insurance is strongly recommended.
3. Any Student who fails to arrive, for any reason whatsoever including illness and has not notified the School, will automatically forfeit the total monies paid and no liability by doing so shall attach to the School whatsoever.

7 LATE RETURN OF SAILING VESSEL

For whatever reason beyond the date of the course. The Students can stay onboard at the company’s vic­tualling expense or return home if they wish at their own expense. No liability shall extend beyond this.

8 UNDER 18’S

Under 18’s accepted when sailing with parent or guardian. All Booking Forms for under 18’s to be signed by parent or guardian, stating this fact after the signature.

9 INSTRUCTION ON YOUR OWN YACHT

a)All conditions herein apply. The price of the tuition and possible extra costs will be paid prior to the commencement of the course, if not agreed otherwise. The price of the course depends on the number of participants, time schedule and the place where the vessel lies.

2. The Student’s vessel will be expected to be equipped with the minimum RYA standards and provide the Instructor with all bedding and victualling whilst on board.
3. Insurances: The Owner must notify his Insurance Company that there will be a qualified Instructor onboard delivering tuition but the Owner remains the Skipper at all times. It is also agreed that the owners insurance is fully comprehensive and covers all aspects of normal marine insurance for the area in which the Skipper is expected to sail, with additional days leeway to allow for adverse weather

10 HEALTH

Students with special medical problems should check that their G.P. considers them safe to sail and advise the School of the condition when booking, and both the Principal and Skipper when reporting for the course. Bring any personal medication necessary.
We reccomend that all Students bring their own seasickness medication. Consult your G.P. or pharmacist about suitable medication.

11 SKIPPER’S/IN­STRUCTOR’S DE­CISIONS

On any of the School vessels, the Instructor is the Skipper and his/her decision is final at all times.

1. Skipper’s Deci­sions: From the moment the Skipper steps onboard the instruction vessel in accordance with marine practice, the Skipper’s decisions are final always.
2. All crew/students will accept all orders and decisions given to them by the Skipper at all times whilst onboard the School’s vessel or ashore, for the duration of the course until the course is complete and the Skipper is no longer onboard the vessel. The Skipper’s authority is total day and night in accordance with Marine Law.
3. If for any reason whatsoever a Student does not accept an order from the Skipper or his designated substitute, whether the Student considers it to be reasonable or not, the Student shall be considered to be in breach of Marine Law. The Skipper shall take any action or decision he considers fit for the well being of the vessel and crew. If The Student is placed ashore at the nearest port no liability whatsoever shall attach itself to the School and neither shall the Student have redress for any expenses or unused portion of the fee, neither any redress against the Skipper or School as a result of actions taken by the Skipper.

12 SEA TIME

Every attempt will be made to give students maximum sea time. However, if in the Skipper’s opinion weather conditions, safety or any other consideration renders it imprudent, the Skipper’s decision is final.

13 VESSEL CHANGE

If the School changes vessels, due to any vessel becoming unsuitable, for any reason whatsoever, or delay in this in no way affects the validity of the booking of the Terms and Conditions stated herein they remain good.

14 SCHOOL CANCELLATION

If, for any reason, the School is unable to fulfil a booking or a vessel becomes unseaworthy for any reason whatsoever, the School will inform the Student immediately the knowledge is available. No liability shall attach itself to the School beyond the refund of the full fee paid by the student(s) or unused portions thereof.

15 SCHOOL INSURANCE

The School is insured for Instruction. However Student’s needs vary. The School strongly advises that the Student obtain their own insurance for Sickness, Illness, School Fees, Illness or Accident onboard, or any other reason the Student considers prudent for his personal life style or well being. The Student agrees the School Insurance Policies are adequate. The Policy is available on request for inspection at the School offices in Brno, Czech republic.

16 DISCLAIMER

No liability is accepted for any Student’s vehicles parked in the Marina grounds, or Student’s Pos­sessions in the vehicle, on the pontoons or in the Schools vessels or accommodation.
No liability is accepted for Students whilst on School grounds, in any of the School properties, on ladders, pontoons or vessels and all Students participate in any aspect of any course at their own risk.

17 BREAKAGES OR DAMAGES

Howsoever caused must be immediately notified to the Skipper or Instructor for safety. Students shall be liable for any loss or damage to School equipment, vessel’s equipment, up to and including the first €100 per item.

18 CERTIFICATES

The School’s standards of instruction are high and certificates will only be issued at the end of a course if, in the opinion of the School’s Instruc­tors and Examiners, the Student has reached the necessary standard. The School’s decision shall be final and accepted by all Students.

19 DUTIES ONBOARD

All Students will be expected to participate in cooking, cleaning vessel and routine maintenance as required by the Instructor.

20 PHYSICAL FITNESS

Sailing is an activity sport and it is the responsibility of the student to ensure that they have an adequate level of fitness. Please check with your G.P. if you are in any doubt. Should you suffer from any condition you should disclose this information to us at the time of booking. This need not disqualify you from participation.

21 COMPLAINTS

If you have any reason for concern, please let your Instructor know at the earliest possible time. If you are not happy with the solution you should contact the Chief Instructor or Principal, we will do our best to satisfy your requirements.
